SUNCOAST NC VACATIONS TERMS & CONDITIONS

THIS IS A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA VACATION RENTAL ACT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR SIGNATURE ON THIS AGREEMENT, PAYMENT OF MONEY, OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL.

1) LIABILITY
SUNCOAST NC VACATIONS is a Property Management Company. Suncoast NC Vacations (Hereinafter the Agent) is a real estate agency which brokers short term vacation rental contracts between clients (Property owners/homeowner) and tenant (renters/guests/Tenant). The properties are private homes and condominium units. When you book a Property, you enter a real-estate contract with the Property owner. Neither the Agent nor the owner is responsible or liable for any loss of the tenant’s personal Property or bodily injury or damage of any nature from any cause to the tenat (including his/her guests, licensees, or invitees). The Agent is not responsible for water conditions, beach conditions, insects, rodents, flies, bedbugs, or other pests, weather conditions, road conditions, power outages, acts of God, criminal activities, economic downturns, political changes, or any other activity, event or condition beyond its control.

2) CHARGES
All reservations require a payment of at least fifty percent (50%) of the reservation total for confirmation. The balance of the reservation shall be due upon the due date disclosed in the cancellation policy notice on the Property page. Reservations made within the final balance due date must be paid in full and charged with a credit card (Visa, MasterCard, American Express or Discover). Your reservation becomes a guaranteed reservation upon monies paid on your account that complies with the reservation requirement and final balance due date (restrictions apply). Reservations are subject to a processing fee, applicable taxes, a cleaning and linen fee, other service fees, and Accidental Protection Plan (PPP), among other potential fees. A Property Protection Plan (PPP) is required.

3) PAYMENTS
Reservations are made by credit or debit card (Visa, MasterCard, American Express or Discover). Personal checks are not accepted. The reservation is not guaranteed until receipt of the total amount due at the time the reservation is made. Credit cards will incur a non-refundable 3% service charge. Credit card payments MUST be placed on a card held in the same name as the responsible party. The Property will be marketed until receipt of payment. If multiple credit cards are used to pay for the reservation, all card-holders are equally responsible for the total cost and also for damages. If the 2nd payment is not paid by the due date, the reservation will be canceled, and the cancellation policy will apply. Acceptance of the terms and conditions is an approval of the automatic charge of final payment to the card used for the initial reservation on the final payment due date. All payments received from Tenant will be held in the Suncoast NC Vacations Trust account at Truist Bank located at 100 Shallotte Crossing Pkwy, Shallotte, NC 28470. Truist Banks is a federally insured depository institutions authorized to do business in North Carolina. Payments may be deposited in an interest-bearing account and any accrued interest shall be disbursed to the Agent.

4) TAXES
As of August 2025 the Brunswick County, North Carolina sales tax is 6.75%. SNCV manages properties located on each of the barrier islands as well as the mainland of Brunswick County, NC. Not all locations impose the same Occupancy Tax. The Towns of Holden Beach, Ocean Isle Beach, Sunset Beach, Oak Island, & Caswell Beach each impose an Occupancy Tax of 6%, making the tax total 12.75%. Calabash an Occupancy Tax is imposed in the amount of 1%, making the tax total 7.75%. All said taxes are imposed to all rentals/bookings/tenancies of 90 days or less. Tenant is responsible for paying all applicable taxes in effect on the date of check in.

5) RESPONSIBLE PARTY
The persons/tenant(s) whose credit cards are used to pay for the reservation accept responsibility for all occupants complying with rental policies, procedures, and restrictions. The responsible party/tenant must be at least 25 years of age and is required to stay in the Property for the time reserved. Aside from normal wear and tear, the tenant is responsible to pay for any damages to the Property or its contents during Property possession under the vacation rental agreement. If damages or excessive cleaning appears to be the result of negligent or deliberate actions or omission, the tenant agrees to a deposit of $1,000 - $3,000 being charged to the credit card to be held in trust until damages are covered. If multiple credit cards are used to pay for the reservation, all card-holders/tenants are equally responsible for the total cost and also for damages. Tenant will not be held responsible for accidental damages less than $3,000 with the Property Protection Plan (PPP).

BE FAMILIAR WITH THESE TERMS AND SEEK UNDERSTANDING/APPROVAL BEFORE BOOKING IF THERE IS ANY QUESTION REGARDING THE APPROPRIATENESS OF YOUR RESERVATION. RESERVATIONS MADE BY PERSONS NOT MEETING THE MINIMUM AGE REQUIREMENT, OR RESERVATIONS BOOKED FOR A PROHIBITED INTENDED USE, MAY FORFEIT ALL MONEY PAID TOWARD THE RESERVATION.

6) DAMAGES, AND MISSING ITEMS
All reservations require an Property Protection Plan (PPP).
The non-refundable Property Protection Plan (PPP) is not insurance. The cost varies per home, and is non-refundable. It is designed to give you peace of mind by making you not responsible for accidental damage to the Property less than $3,000.
Damage excluded from being covered by the PPP includes, though is NOT LIMITED to the following:
Intentional, willful, reckless or malicious acts by any member of the reservation on the Property during the tenancy
Negligent omission
Theft from the Property of the owner’s Property
Damage caused as a result of being under the influence of alcohol or drugs
Damages caused by smoking inside the home
Damages related to gas log fireplaces due to the logs being intentionally re-arranged, or burning items inside the gas log fireplace, such as paper, wood, etc.
Damages to the Property caused by operation of a motorized vehicle (these damages are covered by auto insurance)
Excessive damages done by unattended, uncrated, pets
Gross negligence of tenant or intentional misuse of the Property by having an unauthorized party or gathering resulting in excessive housekeeping and/or damages
Gross negligence of tenant or intentional misuse of furnishing, appliances, equipment or other amenities
In order to initiate the PPP claim to cover accidental damages that occur during your stay, it is necessary to report the damage immediately to reservations@suncoastncvacations.com or by phone 877-575-8767. Damages not reported will be assumed to have occurred due to circumstances not covered by the PPP and thus obligate the responsible party to pay for repairs.

7) CLERICAL ERRORS/INDIVIDUALLY OWNED PROPERTY
The Agent reserves the right to cancel a reservation within 14 days of the booking, or 250 days prior to arrival date if the house was erroneously priced, made available for fewer nights than the minimum allowed by the owner, or other clerical errors. If the reservation is canceled because of a clerical error, the customer is entitled to a full refund. Clerical errors are rare. To avoid the potential of cancellation under this policy, you may ask for a review and confirmation of your reservation. Every Property managed by Agent is privately owned and reflects each owner’s personal taste. Rental rates are typically based on location, amenities, and quality of furnishings. Agent makes every effort to represent each home on Agent’s website and in Agent’s marketing materials as realistically as possible with regard to space, physical condition, and comparisons. However, Agent is not responsible for changes that may be made by homeowners after Agent’s publication nor is Agent responsible for any printing errors. If you have specific personal requirements, please contact SNCV to discuss them. Agent will not be able to make any substitution or refunds upon arrival. Interior photos may be viewed online at www.suncoastncvacations.com. The homeowner may have exterior cameras on Property for safety reasons.

8) CANCELLATION POLICY
To protect your reservation investment dollars, SNCV strongly urges each Tenant to purchase the Trip Preserver™ Travel Plan, a travel insurance plan offered through Red Sky Travel Insurance offered at time of booking. Information provided in section TRAVEL INSURANCE AND MANDATORY EVACUATION. In the event of a cancellation by Tenant, Tenant shall receive a refund of all payments made by Tenant, less any insurance elected, fees incurred such as cancellation fee of $300, processing fee, paid travel insurance (if applicable), credit card fees, plus all applicable taxes if the Property is re-rented on the terms set forth herein. If the Property is not re-rented on the terms set forth herein, Tenant will NOT be entitled to a refund of any rent payment made hereunder. If Agent deems it advisable to reduce the rental amount in order to re-rent the Property, Agent may do so without notice to Tenant. In such event, any refund due to Tenant will be reduced. Whether or not the Property is re-rented, Tenant, rather than Agent, shall be responsible for seeking reimbursement of any fees paid by Tenant to Agent for goods, services, or benefits procured by Agent from third parties for the benefit of Tenant that may have been paid out prior to Tenant’s cancellation.
SNCV reserves the right to cancel a reservation with an overdue balance without notification. SNCV reserves the right to cancel a reservation with or without cause, at its sole discretion. Except for cancelations due to the Tenant’s default under this Agreement, SNCV shall issue a full refund for all payments made by a Tenant within thirty (30) days of such cancelation. Except for permitted cancelations under this Agreement, Guest is responsible for all amounts payable to or by SNCV for any Tenant cancelation, including but not limited to all fees associated with credit card chargebacks or any other similar fees received by Suncoast NC Vacations associated with unpermitted Guest cancelations.

9) TRAVEL INSURANCE AND MANDATORY EVACUATION
(a) Tenant may elect to purchase the Trip Preserver™ Travel Plan, a travel insurance plan offered through Red Sky Travel Insurance. This plan includes coverage for trip cancellation, trip interruption and travel delay, emergency medical expenses, baggage delay and loss, rental car damage, as well as access to emergency assistance service. Insurance coverage is subject to limitations, exclusions, terms and conditions. A complete description of coverage/insurance policy can be found at http://trippreserver.com. The cost for this plan has been offered at time of booking to be included in Tenant’s initial payment. If Tenant wishes to purchase this plan, you must check in the designated area at time of booking an agreement which states that travel insurance is desired. This Agreement is not intended to serve as a substitute for the policy or to define any of the policy terms or provisions. All questions concerning coverage or claims should be directed to Red Sky Travel Insurance at 1-866-889-7409.
NOTE: TENANT’S DECISION WITH RESPECT TO THE PURCHASE OF TRIP INTERRUPTION INSURANCE WILL AFFECT TENANT’S RIGHTS IN THE EVENT OF A MANDATORY EVACUATION. SEE PARAGRAPH (b) BELOW.
(b) If state or local authorities order a mandatory evacuation of an area that includes the Property, Tenant shall comply with the order. Upon compliance, Tenant will be entitled to a refund of the prorated rent for each night that Tenant is unable to occupy the Property because of the order. However, Tenant will NOT be entitled to a refund if, prior to taking possession of the Property: (i) Tenant refused insurance offered by Agent that would have compensated Tenant for losses or damages resulting from loss of use of the Property due to a mandatory evacuation order, or (ii) Tenant purchased such insurance. Tenant is advised that such insurance must be purchased prior to a storm being named in order to be eligible for coverage for hurricane-related issues such as mandatory evacuation.
TRAVEL INSURANCE IS NON-REFUNDABLE AFTER 14 DAYS FROM THE DATE OF PAYMENT AND/OR BOOKING AND IS NON-TRANSFERABLE.

10) RENTAL CAPACITY/VEHICLES
Please check the number of people each Property sleeps as detailed in the online Property description. The maximum occupancy stated on the Property page represents the MAXIMUM number of people, including children, allowed to occupy the Property. Occupancy of the Property shall not exceed the maximum number allowed that is stated on reservation agreement. Tenant agrees to be responsible for ensuring that the maximum permitted occupancy of the Property is not exceeded during the term of this Agreement. Please be aware that some communities have strict standards regarding the number of vehicles allowed to park at a Property. Some areas may not allow motorcycles, RVs, or trailers. You must adhere to these regulations at all times during your stay.

11) EVENTS, GATHERINGS FOR UNRELATED GROUPS, AND HOUSE PARTIES WARNING
Properties are available for lodging accommodations. We do not offer properties as event venues. We do not rent for house parties or events that include accommodating more than the published maximum occupancy. Gatherings and reservations hosting unrelated groups must be approved by Agent. Certain conditions may apply. If your plans include a gathering or involve hosting occupants whose age range and make-up may be construed as a gathering, please seek approval before booking the Property. Acceptable arrangements are determined at the sole discretion of Suncoast NC Vacations. Reservations that appear to include an unapproved gathering may be canceled. The cancellation policy would apply. Please call our office to be approved by Suncoast NC Vacations before booking. The cancellation policy applies to booked reservations that are canceled by the Agent due to inappropriateness of intended use.

12) CHECK IN/CHECK OUT/KEYLESS ENTRY
Most of our properties have keyless entry. Where applicable, the guest pin code will be emailed to Tenant at a date close to the arrival. Tenant agrees that check in time is no earlier than 4 p.m. unless otherwise agreed to in writing. Agent will use commercially reasonable efforts to have the Property ready for Tenant’s occupancy at check in time, but Agent cannot guarantee the exact time of occupancy. Check out is at 10 a.m. – no exceptions will be made. All properties must be vacated and if Agent provided keys/pool fobs returned to Agent no later than 10 a.m. on the date of your departure to avoid any fees. Special instructions with how to check out from the Property will be provided prior to departure. We ask that you carefully follow this important procedure to avoid any fees or interruptions at departure.

13) DEPARTURE CLEANING/LINENS:
Departure cleaning is provided upon check-out and is included in the rental rate quoted. This cleaning is basic cleaning and refunds will not be made if cleaning is unsatisfactory to the arriving Tenant. However, if Tenant notifies Agent of a cleaning issue upon taking possession of the Property, Agent will send a housekeeping team ASAP to address the situation. Every Property is inspected prior to check-in and after check-out and you may be billed if extraordinary cleaning is required. .

14) GRILLING
North Carolina Law prohibits grilling on the decks and balconies of rental properties. Grilling is permitted only on concrete surfaces away from wooded areas or structures. If the Owner provides a grill, tenant is responsible for the cleaning.

15) EQUIPMENT FAILURE AND OTHER INCONVENIENCES
All equipment and advertised amenities should be in working order. Please report any equipment problems to the office immediately. Please be patient if you encounter any inconveniences. All of our properties provide air conditioning, heat, and TV's. No refunds will be made for malfunctions. However, Agent will attempt to provide a replacement or loaner, but supplies are limited. TV service, satellite TV, telephone service and Internet access cannot be guaranteed as we have occasional interruption of service. The Suncoast NC Vacations Team is motivated to serve you and will address issues as quickly as ability and resources allow. The timing of solutions will be affected by when the malfunction occurred, limited authority to affect change, the availability of specialists, and the demands on staffing resources at the time the situation occurs. Refund decisions, regarding appropriateness or amount, for equipment failure and inconveniences are decided by Suncoast NC Vacations and will consider the interests of both parties to the agreement/contract (Property owner and tenant). “Luxury Items” Swimming pools, hot tubs, spas, whirlpools, Jacuzzis, TVs, elevators, golf carts and other such amenities and appliances cannot be guaranteed to be in good working order. Every effort will be made to have them in good working order, but no refunds or discounts will be made in the event they are inoperable during your stay. Tenants use these amenities are at tenants own risk. Each Property is equipped with a helpful Property Guide to assist with the use of equipment, etc.

16) OCEANFRONT STEPS, BOARDWALKS, DOCKS AND WALKWAYS
Our area is prone to storms and nor'easters which may change the beach topography in many areas from year to year. Steps, docks and boardwalks may be missing or may not be replaced due to storm damage. NC Coastal Area Management Act guidelines sometimes prohibit the reconstruction of steps in narrow beach areas. Please ask SNCV for beach access information for your Property. The photo in the brochure or website may not accurately reflect the design of oceanfront steps, boardwalks, dune decks, docks or gazebos.

17) CONSTRUCTION
Occasionally, you may experience construction in your area during your stay. Please be patient and understanding if this situation should arise. SNCV will do everything possible to contact the contractor if this is a problem and see if they can change their hours of work. Hours of work is allowed from 7am until 7pm every day. However, no refunds can be made and we will be unable to move you to another Property in the event of construction noise or problems.

18) ELEVATORS
Some of our Properties offer elevators to aid with those with limited mobility. Elevators cannot be guaranteed to be in good working order. Every effort will be made to have them in good working order but no refunds or discounts will be made in the event they are inoperable during your stay. Guests use these amenities at their own risk. Children must ride the elevator with an adult.

19) HOT TUBS
If a hot tub is provided with your Property, it will be prepared and tested for proper and safe chemical levels by a certified pool and spa operator prior to or on the day of your occupancy. The treatment is designed to last the duration of a one-week stay. Rules and regulations are posted and must be followed. Misuse of tubs by spilling of foreign substances, excessive sand, suntan oil, etc. will incur a service call charge. An additional mid-week clean is available at $75 per service. No hot tubs or pools other than those supplied with the Property are permitted unless prior approval is given by SNCV. Under no circumstances are pets allowed in hot tubs or pools. Violation of this rule may result in expedited eviction.

20) SWIMMING POOLS
Many rental guests love the idea of extending the swimming season by choosing homes with private pools. Realistically, the weather is favorable for outside pool use only from late April through mid-October even when heated. (If available, pools may be heated for any additional charge). Private pools in Properties will be open from mid-April through the end of October, weather permitting. A limited number of our Properties may elect to make the pool available outside these dates for an additional rental amount/fee. Please check with SNCV for availability and the additional rental amount/fee if you are interested in this option. Misuse of pools by spilling of foreign substances, excessive sand, suntan oil, etc. will incur a service call charge. Under no circumstances are pets allowed in pools. Violation of this rule may result in expedited eviction. Swimming pools are listed in the Property description if they are available. The hours of operation and time of year for swimming pools (especially in private subdivisions or condominium complexes) to be available for use is at the sole discretion of the Homeowner's Association and/or complex manager. Swimming pools are generally available for use from Memorial Day to Labor Day. Our SNCV Team will be happy to answer specific questions.

21) SERVICE ANIMALS
Service animals are not pets; they are working animals that assist persons with disabilities. Federal law prohibits the exclusion of service animals on any Property. Therefore, Agent cannot guarantee an environment free of animal dander to any Tenant. Agent must be notified at time of booking if an emotional support or assistance animal will be on Property during the rental period.

22) PETS
Unless otherwise specifically permitted in this Agreement (including any addendum hereto), no pets shall be allowed on the Property. Agent and the homeowner only allow pets in pet friendly designated properties. In those properties, there is a limit of two house-trained dogs under 40lbs per Property. Absolutely no other type of animal is allowed on the Property either inside the Property or on the grounds of the Property. A one-time, nonrefundable fee will be charged per pet. In addition, Tenant will be required to pay exterminating and/or extraordinary cleaning fees if any approved pet causes an infestation or damage to the Property. Tenant’s breach of this provision will be considered material, and will result in the termination of Tenant’s tenancy and forfeiture of any monies paid, and a charge to address carpet cleaning, pest control and any other remediation concerns. Evidence of a pet at the Property (pet friendly Property) without prior approval may result in a $150 fee in addition to the pet fee charged to the credit card on file post-departure.
Please note that we cannot guarantee that properties advertised as not allowing pets have never had a pet in the Property.

23) SUBSTITUTION
Agent reserves the right to substitute accommodations if circumstances require. Circumstances include but are not limited to acts of nature; Owner of the Property removes their Property from availability, malfunctions, or other accidents or incidents that render a Property uninhabitable. In the event that a Property becomes unavailable, the Agent will contact the tenant to offer alternative properties or a full refund. Any additional costs will be the sole responsibility of the Tenant.

24) ITEMS LEFT IN PROPERTY
Suncoast NC Vacations is not responsible for items left in rental properties. It is important to check thoroughly before departing to avoid leaving your belongings. If you failed to remove and pack a belonging, inform us immediately if you want lost and found service. We will attempt to locate the item, deliver it to the office, and arrange to ship to the address you provide. But please remember that success with locating and returning the item to you/tenant is affected by many variables. So there is no guarantee that left items will be found. If you contact SNCV and request service related to a lost and found item, you will be charged for the service (generally $35 but is subject to change). Shipping will not be charged unless we successfully locate and deliver the item for shipping. Items found and are unclaimed will be donated to a local charity after 30 days.

25) OWNER'S CLOSETS OR OTHER LOCKED AREAS
It is normal for a portion of the Property to be locked and unavailable for Tenant use. Locked closets or other areas are reserved for storage of the owner's private Property. Locked areas are not included with a reservation. Entry to locked areas of the house will be considered illegal trespassing.

26) ENTRY
Under special circumstances, it may be necessary for the Agent to enter the Property during reasonable hours for any purpose connected with the repair, care or management of the Property. The tenant agrees that the Agent, the owner, or their respective representatives may enter the Property during reasonable hours to inspect the Property, to make such repairs, alteration or improvements thereto as the Agent or owner may deem appropriate, or to show the Property to prospective purchasers or tenants. Acceptance of terms and conditions is acknowledgment and acceptance of this information by the tenant.

27) DISBURSEMENT OF RENT TO THIRD PARTIES/FEES
Tenant authorizes Agent to disburse up to fifty percent (50%) of the rent set forth in this Agreement to the owner (or as the owner directs) prior to Tenant’s occupancy of the Property. The balance of the rent shall be disbursed to owner upon the commencement of the tenancy or upon a material breach of this Agreement by Tenant, or as otherwise permitted under the Vacation Rental Act (the “VRA”). Tenant also authorizes Agent to disburse prior to Tenant’s occupancy of the Property any fees owed to third parties to pay for any goods, services, or benefits procured by Agent for the benefit of Tenant, including but not limited to any fees set forth herein payable to Agent for reservation, transfer or cancellation of Tenant’s tenancy. Agent may receive fees or commission on services offered or performed by third parties, including but not limited to Travel Insurance or Property Protection Plan (PPP).

28) TRANSFER OF PROPERTY
If the owner voluntarily transfers the Property, the tenant has the right to enforce this agreement against the grantee of the Property. The VRA gives Tenant the right to enforce this Agreement against the new owner of the Property if Tenant’s occupancy under this Agreement is to end 180 days or less after the transfer of ownership is recorded. If Tenant’s occupancy is to end more than 180 days after such recordation, Tenant has no right to enforce the terms of this Agreement unless the new owner agrees in writing to honor this Agreement. If the new owner does not honor this Agreement, Tenant is entitled to a refund of all advance rent paid (and other fees owed to third parties not already lawfully disbursed). If Tenant’s rights are otherwise affected by a termination of the owner’s interest in the Property, Agent will notify Tenant and will conduct itself in accordance with the terms and conditions of the VRA.

Upon termination of the owner's interest in the Property, whether by sale, assignment, death, the appointment of a receiver or otherwise, the owner, owner's Agent, or real estate Agent is required to transfer all advance rent and fees paid by tenant to the owner's successor-in-interest within 30 days and notify the tenant of such transfer and of the transferee's name and address. However, if tenant's occupancy under this agreement is to end more than 180 days after recordation of the interest of the owner's successor-in-interest in the Property, and the successor-in-interest has not agreed to honor this agreement, all advance rent paid by tenant must be transferred to the tenant within 30 days.

If the owner's interest in the Property is involuntarily transferred prior to the tenant's occupancy of the Property, the owner is required to refund to the tenant all advance rent paid by tenant within 60 days of the transfer.

29) Foreclosure: After signing this agreement, if Agent learns of a foreclosure of this property, Agent will (a) notify Leaseholder, (b) not disburse further sums to the Owner of the Property, (c) request the Owner return to us the rents you have paid and (d) attempt to relocate you to a reasonably comparable property. If the Owner does not return the rent you have paid, your claim is against the Owner, not Agent.

30) TENANT DUTIES
Tenant agrees to be a polite and conscientious neighbor, and to comply with all obligations imposed by the Vacation Rental Act with respect to maintenance of the Property, including but not limited to keeping the Property as clean and safe as the conditions of the Property permit and causing no unsafe or unsanitary conditions in the common areas and remainder of the Property that Tenant uses;(ii) not deliberately or negligently destroying, defacing, damaging, or removing any part of the Property, or knowingly permitting any person to do so; and (iii) notifying Agent in writing via email reservations@suncoastncvacations.com of the need of replacement of or repairs to smoke detector, and replacing the batteries in the smoke detector as needed during the tenancy. Tenant agrees not to use the Property or amenities for any activity or purpose that violates any criminal or copyright law, governmental or local regulation, including noise ordinances, local parking restrictions, and illegal use of the internet.

This short term rental contract does not permit use for any commercial purposes (including but not limited to photo shoots, video productions, livestreams, or content creation for monetized platforms) without prior written approval. Unauthorized commercial filming or photography will result in immediate termination of the stay and forfeiture of all rental monies paid including fees.

Tenant's breach of any duty contained in these terms and conditions shall be considered material and shall result in the termination of tenancy with no refund of rent. Suncoast NC Vacations will cooperate with any investigation of illegal activity that seeks to hold perpetrators responsible. To protect owner and Agent in the event of Property damage caused by Tenant, Tenant must have a valid credit card on file in the Tenant’s name. A copy of a valid driver’s license may be required upon arrival before occupancy is permitted. Agent has the right to require Tenant to check-in at Agent’s office during office hours before access to the Property is granted.

31) AGENTS DUTIES
Owner is required to provide the Property in a fit and habitable condition. Section 17(b) of the VRA states that, except as provided in the VRA’s mandatory evacuation provision, if, at the time Tenant is to begin occupancy of the Property, the owner or the Agent cannot provide the Property in a fit and habitable condition or substitute a reasonably comparable Property in such condition, Agent shall refund to Tenant all payments made by Tenant.

AGENT SHALL CONDUCT ALL BROKERAGE ACTIVITIES IN REGARD TO THE AGREEMENT WITHOUT RESPECT TO THE RACE, COLOR, RELIGION, SEX, NATIONAL ORIGIN, HANDICAP, FAMILIAL STATUS, SEXUAL ORIENTATION, OR GENDER IDENTITY OF ANY TENANT/TENANT.

32) EXPEDITED EVICTION
If the tenancy created hereunder is for 30 days or less the expedited eviction procedures set forth in the Vacation Rental Act will apply. The tenant may be evicted under such procedures if the tenant: (i) holds over in possession after the terms of the tenant's rental agreement has expired, (ii) commits a material breach of any provision of the agreement (including any addendum hereto) that according to its terms would result in the termination of the tenant's tenancy; (iii) fails to pay rent as required by this agreement; or (iv) has obtained possession of the Property by fraud or misrepresentation.

33) INDEMNIFICATION AND HOLD HARMLESS
Tenant agrees to indemnify and hold harmless the Agent and the client/owner from and against any liability for personal injury or Property damage sustained by any person (including the tenant's guests) as a result of any cause unless caused by the negligent or willful act of the Agent or the owner, or the failure of the Agent or the owner to comply with the Vacation Rental Act. Tenant agrees that Agent, the owner/client or their respective representatives may enter the Property during reasonable hours to inspect the Property, to make such repairs, alterations or improvements thereto as Agent or owner/client may deem appropriate, or to show the Property to prospective purchasers or tenants. Tenant shall not assign this Agreement or sublet the Property in whole or part without written permission of Agent.

34) RESOLUTION
Any claim or dispute arising from or related to this agreement shall be settled by first discussing the matter, secondly by mediation and, if necessary, by legally binding arbitration. Judgment upon an arbitration decision may be entered in any court otherwise having jurisdiction. The parties understand that these methods shall be the sole remedy for any controversy or claim arising out of this agreement and expressly waive their right to file a lawsuit in any civil court against one another for such disputes, except to enforce an arbitration decision.

35) NO SMOKING
ALL of our properties are NON-SMOKING properties. You may not use smoking or vaping products of any kind inside the Properties. Any evidence of smoking or smoke smell will result in a fine of $300.00 plus the cost of any damage or odor fumigation/ remediation and possibly to reimburse the Property owner for time off the market, should remediation require extended time. Any costs related to smoking will not be covered by the PPP.

36) AMERICANS WITH DISABILITIES
The properties in our vacation rental program are privately owned residences, and NONE of the properties meet the standards to be ADA Compliant.

37) GUEST COMPLIANCE WITH PROPERTY MANAGEMENT ASSOCIATION (POA) RULES AND REGULATIONS
If a Property you have leased is part of a Property Management Association (POA) by agreeing to these terms and conditions, the Tenant acknowledges and agrees to abide by all rules and regulations set forth by the Property Management Association (POA). This includes, but is not limited to, guidelines regarding Property use, behavior, and any other directives established by the POA for the maintenance and well-being of the community. The Tenant consents to the disclosure of their contact information to the POA for the purpose of communication and enforcement of POA rules and regulations. This may include, but is not limited to, name, address, email, and phone number. The POA will handle this information in accordance with its privacy policy and applicable laws. The Tenant agrees to respect and adhere to these rules throughout the duration of their stay/tenancy.

38) CONSENT TO CONTACT
By providing your contact information to Suncoast NC Vacations, you agree/opt in that we may contact you via email, phone, and texting for the following purposes:
To provide you with information about your booking/reservation, including confirmation emails, reminders, and updates.
To send you promotional offers and discounts for our services or products.
To conduct surveys or collect feedback from you.
To resolve customer service issues.
To send you important announcements or safety alerts.
We understand that you may not want to receive all of these types of communications from us. You can opt out of receiving any or all of these communications at any time via the following methods.
Email - If you opt in to email communications, we will send you emails related to your booking/reservation, such as confirmation emails, reminders, and updates. We may also send you promotional emails about our services or products, or to conduct surveys or collect feedback from you. You can unsubscribe from promotional emails at any time by clicking the unsubscribe link in the email.
Phone - If you opt in to phone communications, we may call you to provide you with information about your booking/ reservation, to resolve customer service issues, or to send you promotional offers and discounts for our services or products. You can ask us to stop calling you at any time by hanging up the phone.
Texting - If you opt in to texting communications, we may text you to provide you with information about your booking/reservation, to resolve customer service issues, or to send you promotional offers and discounts for our services or products. You can unsubscribe from promotional texts at any time by replying to the text with "STOP".
Suncoast NC Vacations will not sell your data to third parties.

ALL RESERVATIONS MADE BY TENANT VIA THE INTERNET/WEB HAVE ACCEPTED AND AGREED TO ALL TERMS IN THIS AGREEMENT IN FULL BY CHECKING THE BOX IN THE RESERVATION PROCESS. YOU CANNOT GET TO STEP 2 OF THE RESERVATION PROCESS AND PAY FOR YOUR RESERVATION WITHOUT CHECKING THIS BOX AND ACCEPTING.
IF THIS RESERVATION WAS MADE WITH SUNCOAST NC VACATIONS, THROUGH ANY MEANS OTHER THAN THE ONLINE BOOKING/RESERVATION SYSTEM, THIS AGREEMENT IS EMAILED TO YOU ALONG WITH YOUR RESERVATION CONFIRMATION. WHILE PAYMENT OF MONEY, OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL.

ACKNOWLEDGMENT:

I agree to abide by the rules and policies herein as well as those pertaining to the Property I am renting. Failure to adhere to the rules and policies may result in forfeiture of my deposit and/or denial of occupancy without refund. I agree with the rules and policies. I will not bring a pet to a Property that does not allow such. I authorize the use of my credit card for any damages incurred during my tenancy.

I agree that this is a legally binding document/agreement/contract and I have read and agreed to all terms and conditions in this document/agreement/contract. Tenant is advised to seek competent advice if any of its terms are not understood. This Agreement shall be governed by and interpreted in accordance with North Carolina law. This A document/agreement/contract shall be treated as though it was executed in Brunswick County, North Carolina, and performed in Brunswick County, North Carolina. Any action relating to this Agreement shall be instituted and prosecuted in the North Carolina state courts. Tenant specifically consents to such jurisdiction and to extraterritorial service of process. Any amendments to this Agreement must be in writing and signed by all parties. This document/agreement/contract represents the entire document/agreement/contract of the parties.
